1. Introduction

These Terms of Service (“Terms”) govern your access to and use of the FishSignal platform, operated by Egret Studios LLC (“Company”, “we”, “us”, or “our”). By creating an account, accessing, or using FishSignal (the “Service”), you agree to be bound by these Terms. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Description of Service

FishSignal provides real-time Florida commercial fishing regulatory, quota, weather, and related data, aggregated from third-party official sources. While we strive for accuracy, we do not guarantee completeness, timeliness, or reliability of any information provided.

4. Subscriptions and Payments

Access to the Service requires an active paid subscription. All billing is handled securely through Stripe. Subscriptions automatically renew at the end of each billing cycle unless canceled prior to renewal. All sales are final. We do not offer refunds or credits for partial months of service, or for unused time on an active account.

5. License and Restrictions

We grant you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes. You agree not to:

• • Resell, redistribute, or publicly display our data without prior written consent.
• • Use the Service for unlawful purposes.
• • Scrape, harvest, or attempt to reverse-engineer the platform.

6. Data and Third-Party Sources

Data is sourced from official agencies such as FWC, NOAA, Gulf Council, and others. These agencies may update, modify, or retract data without notice. You acknowledge that decisions you make based on the data are at your own risk.

7. Account Responsibilities

You are responsible for safeguarding your account credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.

8. Termination

We may suspend or terminate your access to the Service at any time, without notice, if you violate these Terms or engage in fraudulent, abusive, or unlawful activity.

9. Limitation of Liability

To the maximum extent permitted by law, Egret Studios LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any errors or omissions in the data; or (c) any unauthorized access to or use of our servers.

10. Indemnification

You agree to defend, indemnify, and hold harmless Egret Studios LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the Service or violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed under the laws of the State of New Mexico, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Bernalillo County, New Mexico.

12. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or through the Service before the changes take effect. Continued use of the Service after such changes constitutes your acceptance of the new Terms.
